Contracts

This agreement is made, and hereby entered into, on this ___ day of _________, 20__ by and between __________________________________(hereafter referred to as "Seller"), and _________________________ (hereafter referred to as "Buyer"), for the purpose of setting forth the terms and conditions of the purchase by the Buyer of a purebred Rottweiler from the litter whelped on _________ out of ;

Sire:____________________ AKC #:__________________ and

Dam:_____________________ AKC #: ___________________,

AKC Reg # of litter:_____________________.

1. The Seller agrees to sell and the Buyer agrees to buy (check appropriate line)
____ show male ___ show female ____ pet male ___ pet female puppy from the above described litter.

2. The Seller warrants that the above described puppy is in good health and free of communicable diseases at the time Buyer assumes ownership. Buyer agrees to have the puppy examined by a licensed Veterinarian within 72 hours (not including weekends or holidays) of receipt of the puppy. Proof of inspection will be required prior to the Seller forwarding AKC registration papers to the Buyer.

¤ OFA certification for hips.
¤ Current negative Brucellosis report from. Vet
¤ All inoculations and worming up to date.

If, as a result of the examination, the Veterinarian determines that the puppy is not in good health, then the Buyer shall elect to keep the puppy or return the puppy to the Seller for a replacement of equal quality. If the Buyer elects to return the puppy, the Buyer shall within 10 days after the date of the signing of this contract, send to the Seller, by certified mail, a written Veterinarian's certificate stating that the puppy was in ill health when examined. Upon receipt of the puppy, the Seller shall be obligated to replace the puppy with one of equal quality from the current litter or future litter of the above mentioned sire and dam, and further performance under this contract shall be null and void. All action taken to return the puppy shall be with the best interest of the puppy in mind, including temperature at time of shipment, non-stop flights, etc.

3. The seller guarantees "show" quality puppy to be free from disqualifying faults as set out by the AKC. Buyer agrees to provide substantiation of disqualification at a minimum of three AKC sanctioned dog shows. Buyer can either agree to keep the puppy with spay or neuter or may return it to the Seller for a replacement puppy of equal quality. Buyer may also elect to keep the puppy and purchase a new one minus pet price. (not to include any costs for transportation).

4. The Buyer agrees that any and all transportation costs, to and/or from the Seller's premises, will be at the cost and sole responsibility of the Buyer.

5. The Buyer agrees to maintain preventative health care of the puppy including, but not limited to : inoculations, internal as well as external parasites, heartworm preventative medication.

6. The Buyer agrees to maintain preventative care of the puppy in regards to hip dysplasia, such as proper nutrition, proper exercise, and preventing stress injuries (i.e.. not allowing the puppy to jump from heights taller than itself at the shoulder, no forced exercise such as running, until at least 12 months of age.)

7. Ownership of the puppy shall be transferred to the Buyer for the sale price of $_________, to be paid in full on or before ________. Only after the full amount of the agreed upon amount is paid, may the puppy be removed from the Seller's premises. If the balance is left unpaid by such date as of the _________, this agreement shall be canceled at the Seller's option and the Buyer shall forfeit the deposit given hereunder. Under no circumstance will any deposits be refunded. Unless the litter isn't large enough to fulfill all requests or if a litter isn't whelped after said breeding takes place.

8. If the puppy is being sold as Pet quality, the Buyer agrees to have the puppy spayed/neutered by the time it is of at least 6 months of age. And upon receipt of certificate of spay/neuter, the Seller will then forward to the Buyer the AKC registration papers.

Should the Buyer not see to meeting this section of this agreement, the Seller may then execute the right to repossess the puppy without refund of any monies paid to the Seller.

9. If the puppy is being sold as Show quality, and the puppy is diagnosed with crippling hip dysplasia at 24 months of age by both the Buyer's and the Seller's Veterinarians, or by the Orthopedic Foundation for Animals (OFA), the Buyer can either agree to keep the puppy with spay or neuter or may return it to the Seller for a replacement puppy of equal quality. Buyer may also elect to keep the puppy and purchase a new one minus pet price. (not to include any costs for transportation).

10. The Buyer agrees that this animal will not be used for breeding purposes until it is at least 24 months of age to another Rottweiler (which must meet the following criteria as well) either registered with the AKC or other certified dog registry (ADRK, UKC, CKC) and Only after it has passed the following and has proof thereof :

¤ OFA certification for hips.
¤ Current negative Brucellosis report from. Vet
¤ All inoculations and worming up to date.

Should the Buyer breed the animal before ALL the requirements listed in this section are met, the Buyer acknowledges the Seller's right to execute their right to repossess the animal that this contract pertains to. If the animal in question is a bitch, the Seller may also repossess any and all offspring derived from the breeding in question. There will be NO refund of any monies paid and will be left to the Seller's discretion as to the placement of the animal and any of it's offspring.

11. The Buyer agrees not to start Schutzhund Bite / Protection Training of this animal, until it has reached a minimum of 8 months of age. (Thus allowing the animal the physical as well as mental maturity level not to harm or damage the animal.

12. The Buyer agrees that he/she us not acting as or in part of, an agent in the purchase of this puppy and that the Buyer will not sell this puppy or it's any of it's progeny to any agent, pet store, or guard dog business.

13. The Buyer agrees that should it become necessary to sell or otherwise place this puppy, the Buyer will notify the Seller before taking such action so that the puppy may, at the Seller's option, be re-purchased by the Seller.

Upon notification, the Seller shall have 21 working days to exercise said re-purchase option. Exercise shall be notice in writing sent to the Buyer.

14. The Buyer agrees that the Seller may repossess the animal upon evidence of neglect and/or abuse at no expense to the Seller, and no refund of any monies.

15. The Buyer agrees that the puppy will NOT be left alone in a backyard or kennel Only. The Buyer agrees that the puppy will reside at the home of the Buyer, and not be chained or "tied out". (see section 14) This animal is sold with the understanding that it was to go to select homes, socialized properly, and become a member of the family.

16. Buyer agrees to release and hold harmless Seller for any and all liability, damages, or injuries, caused either directly or indirectly by Puppy to any person, animal, whether actual or legal, or to any property whether real or personal. Furthermore, Buyer assumes full liability for any damages or injuries, whether physical or mental, emotional or economic, caused by Puppy, to any person whether actual or legal, or to any property, whether real or personal, after receiving and acknowledging delivery and possession of Puppy.

This Agreement is made and signed by both parties to insure the well being and protection of this animal. If any part of this Agreement is breached, the Seller is released from any further obligations hereunder.

Should the Seller need to seek legal action against the Buyer for violations of this Agreement, the Buyer will assume any and all attorney costs and court fees.
